What to do when OSHA walks in

01

Stay calm. Do not volunteer information.

Answer only what is directly asked. Inspectors are trained interviewers — anything you say is on record. Polite and brief is the rule.

02

Ask for credentials and the scope of the visit.

Request the inspector's ID and a written description of why they are there. A programmed inspection, a complaint, and a fatality investigation are handled very differently.

03

Delay the walkaround — you have the right.

Tell the inspector you are calling your safety consultant. You are not refusing entry. You are exercising your right to have representation present during the inspection.

04

Call Greenberg Safety immediately.

(512) 585-7070. We will advise you on the call and dispatch to your site if needed.

Note on fatality and catastrophe investigations: These carry higher scrutiny and can result in criminal referrals. Do not make statements without a consultant present.

Your 15-working-day window

Got a citation? You have a short window to act.

From the day you receive an OSHA citation, you have 15 working days to file a Notice of Contest — or the penalties become final and permanent.

Before that deadline, there is an informal conference stage where an experienced consultant can negotiate penalty reductions, reclassify violations from willful to other-than-serious, and eliminate abatement requirements that don't fit your actual conditions.

Most contractors who try to handle citations alone leave money on the table — or agree to abatement they didn't have to do.

What we handle

Every type of OSHA crisis, covered

Surprise programmed inspections

OSHA targets high-hazard industries for scheduled inspections. We join the walkaround, manage documentation, and limit scope creep.

Fatality & catastrophic event investigations

If someone was killed or hospitalized, OSHA must be notified within 8 hours. We help you respond correctly and protect your team in the investigation.

Complaint-driven inspections

A worker or competitor filed a complaint. We help you understand the allegation, prepare your response, and correct any real gaps before OSHA arrives.

Citation contests & informal conferences

We negotiate penalty reductions and violation reclassifications before the 15-day contest deadline. Most citations are negotiable — most contractors don't know that.

Abatement documentation & verification

Cited violations require documented abatement. We prepare the written evidence OSHA needs and verify your corrective actions will hold up.

Repeat violation & willful citation defense

Repeat and willful citations carry up to 10× the penalty of standard violations. These require immediate, experienced intervention — not paperwork.

The penalties are real — and negotiable.

Most contractors treat OSHA citations like a bill to pay. The ones who hire a consultant first treat them like what they are: an opening position in a negotiation.

An informal conference — held before you file a Notice of Contest — is where the real work happens. Penalties get reduced. Violations get reclassified. Abatement timelines get extended. It costs nothing to request one, and a skilled advocate at your side dramatically changes the outcome.

We have sat in these conferences on the contractor's side. We know what documentation matters, what OSHA's actual flexibility is, and what arguments close the gap.
